Conference: Association of American Law Schools (AALS): 2024 Annual Meeting
Panel: “Transitional Justice Norms in Defense of Democratic Principles”
Description: Panelists will discuss transitional justice – the idea that a successor regime needs to engage in some form of redress for past human rights violations. Transitional justice mechanisms include accountability, but also truth commissions, reparations, security sector reform, as well as gender justice, sustainable development goals, etc. Since the early 1990s, the importance of the various transitional justice mechanisms has been repeatedly emphasized as a necessary ingredient in rebuilding post-conflict societies, and in ensuring that violence does not flare up again in the future. Panelists will discuss the role of such transitional justice processes in defending democracy within conflict and crises situations, as well as in post-conflict situations, including in Sudan, South Sudan, Colombia, Myanmar, and the Philippines.
